These terms and conditions outline the rules and regulations for the use of Samakaya Pilates and Movement, LLC’s Website, located at http://www.ginnymassie.com and http://www.samakayapilates.com.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Pilates Education With Ginny Massie and Samakaya Pilates and Movement, LLC if you do not agree to take all of the terms and conditions stated on this page.

Cancellation and Liability

In-Person and Live Streaming Events:

Cancellation and Reschedule Policy:

Samakaya Pilates and Movement has a very strict 24-hour cancellation policy. If you need to cancel, please do so at least 24-hours before your appointed time or you will still be responsible for paying for the session.

If you need to reschedule, please contact Ginny immediately. If you miss an appointment without contacting Ginny, you will be charged in full.

There are no exceptions to this policy.

Liability:

Your agreement to a session (session means class, private session, masterclass or any recorded events) means that you agree to the following:

I understand that I have enrolled in a program of strenuous physical activity including but not limited to body-conditioning apparatus used during my Pilates and movement workouts. I hereby absolve Ginny Massie and Samakaya Pilates and Movement, LLC from any responsibility for injuries I might sustain while practicing the Pilates method of body conditioning or any actions learned with or by Ginny Massie and Samakaya Pilates and Movement, LLC.

I hereby release for myself, my heirs and assigns, Ginny Massie, Samakaya Pilates and Movement, LLC (and any employees) from any claims, demands and causes of actions arising from my participation in an exercise program.

Agreement to this Cancellation and Liability Information will act as your continued agreement to all ensuing sessions, workshops and/or seminars whether in person, via Zoom, Skype, or any other video conferencing tool.

Recorded Events:

Cancellation Policy:

Once registered for recordings, there is a zero cancellation policy. That means that you cannot cancel your registration for recordings once you have paid for them. There are no refunds.

There are no exceptions to this policy.

Liability:

Your agreement to view the recording of this set of sessions and all ensuing sessions (sessions includes workshops, seminars or any recorded material) with Ginny Massie and Samakaya Pilates and Movement, LLC means that you agree to the following:

Participation in a Live-Stream Photo Release:

All classes and events are recorded for on-demand video; by participating in class you consent to be recorded for this as well.

When participating in a Live-Stream Event (or any other spelling of the sort), you agree to the following:

Photograph & Video Release:

I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area.

Photographic, audio or video recordings may be used for the following purposes:
conference presentations
educational presentations or courses
informational presentations
on-line educational courses
educational videos
on-demand classes
marketing material for the event (such as, but not limited to, social media and website)

By participating in any recorded live-stream with Ginny Massie or Samakaya Pilates and Movement, LLC, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting.

I will be consulted about the use of the photographs or video recordings for any purpose other than those listed above.

There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.

This release applies to photographic, audio or video recordings collected as part of the recorded live-stream sessions, workouts, classes, webinars, masterclass, seminars you register for with Ginny Massie or Samakaya Pilates and Movement, LLC.

By participating in any recorded live-stream with Ginny Massie or Samakaya Pilates and Movement, LLC, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.

Recordings, Handouts and Manuals

Agreement to Not Reproduce, Share, Sell, or Redistribute the Recording:

Once you have the ability to view any of Ginny Massie or Samakaya Pilates and Movement, LLC’s video recordings, you agree that you will not share login credentials or make any copies of it in any manner for any reason.

Only authorized users, who have duly attained access to any programs or recorded events (including but not limited to, workshops, seminars, masterclasses, on-demand classes, or any recorded material) offered by Ginny Massie or Samakaya Pilates and Movement, LLC by purchasing and personally agreeing to the terms of this agreement are permitted use and participate with such programs.

You shall not provide or make available any login credentials, documentation, video, audio, or materials to any third party.

You shall not use the documentation, video, audio, materials, or any login member credentials to reproduce, sell, or redistribute to any other third party through workshops, education, seminars, or events of the like, or otherwise disclose or discuss information revealed in any portion of the program(s) for any purpose other than instructing your personal clients for the benefit of exercise and client retention.

Agreement to Not Reproduce, Share, Sell, or Redistribute the Handout / Materials / Manual:

You agree that you will make only one printout of the handout. You agree that you will not reproduce, share, sell, or redistribute any handout, manual, or printed material with anyone in any format hardcopy, electronic, or any other format. You recognize that these materials belong to Ginny Massie or Samakaya Pilates and Movement, LLC.

Product Returns

There are no returns on downloaded items or products accessed via the internet.
